These Terms of Use (“Terms”) govern your access to and use of the Toujours website, online store, products, services, Collection Kits, personalized keepsake services, and related features (collectively, the “Services”).

By accessing our website, creating an account, placing an order, submitting pet hair, fur, ashes, photographs, stories, personalization information, or otherwise using our Services, you agree to these Terms.

If you do not agree with these Terms, please do not use our Services.

For purposes of these Terms, “Toujours,” “we,” “us,” and “our” refer to Toujours LLC, and “you” or “customer” refers to the person accessing or using our Services.

1. Our Services

Toujours creates personalized jewelry, keepsakes, and related products designed around the bond between people and their pets.

Depending on the product selected, our Services may involve customer-provided materials such as:

Pet hair or fur
Cremated remains
Photographs
Written memories or stories
Names, dates, or personalization details
Other materials specifically approved by Toujours

Certain products are individually handmade and may be created using resin, metal, textiles, gemstones, or other materials.

Product availability, materials, designs, production methods, and specifications may change from time to time.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order or submit pet hair, fur, ashes, or other keepsake material to Toujours.

By using our Services, you represent that you have the legal capacity to enter into these Terms.

3. Product Information

We make reasonable efforts to display our products, colors, dimensions, materials, and finishes accurately.

However, photographs and digital displays may not perfectly represent the appearance of a finished physical product. Screen settings, lighting, natural materials, handmade processes, resin characteristics, hair or fur color, and other factors may affect appearance.

Measurements are approximate unless expressly stated otherwise.

4. Handmade & Personalized Products

Many Toujours pieces are individually handmade rather than mass-produced.

Because each piece may incorporate natural or customer-provided material, variations may occur in:

Hair or fur placement
Color
Density
Transparency
Resin appearance
Shape
Surface finish
Distribution of ashes or other inclusions
Small details associated with handcrafting

These variations are part of the individual nature of the product and do not necessarily constitute defects.

No two personalized Toujours pieces are expected to be completely identical.

5. Customer-Provided Keepsake Material

By sending pet hair, fur, ashes, photographs, or other material to Toujours, you represent and warrant that:

You have the lawful right and authority to provide the material to us.
The material belongs to you or you have permission from the lawful owner to use it.
Your submission does not violate another person’s rights.
The material has been prepared and packaged according to our instructions.
Any information you provide regarding the material is accurate to the best of your knowledge.

Please do not submit materials that you are not authorized to possess or use.

6. Irreplaceable Materials

We recognize that pet hair, fur, ashes, photographs, and other keepsake materials may be emotionally significant and irreplaceable.

Customers should never send their entire supply of an irreplaceable material when only a small amount is requested.

Please retain a meaningful portion at home whenever possible.

While we use reasonable procedures intended to protect and identify customer-provided materials, no shipping, handling, storage, or production process can eliminate every possible risk of loss, damage, deterioration, or accidental destruction.

Any limitations of liability under these Terms apply only to the extent permitted by applicable law and do not eliminate rights that cannot legally be waived.

7. Collection Kits

Certain personalized products may include a Toujours Collection Kit.

Collection Kits may contain:

Collection bags, containers, or pouches
Instructions
Return packaging
Prepaid shipping labels
Memory or story cards
Other materials related to your order

You are responsible for following the instructions included with the Collection Kit.

Different shipping procedures may apply depending on whether you are sending hair, fur, ashes, or another material.

Do not substitute shipping methods for cremated remains unless expressly permitted by applicable law and our instructions.

Please contact us before shipping if you are uncertain how to prepare your material.

8. Cremated Remains

Orders involving cremated remains may be subject to special postal, carrier, packaging, labeling, and transportation requirements.

Customers are responsible for following the instructions provided by Toujours and all applicable shipping requirements.

We may decline, delay, or return a shipment that has been packaged or shipped in a manner that we reasonably believe is unsafe, unlawful, improperly identified, or inconsistent with carrier requirements.

9. Amount of Keepsake Material

Only a small amount of hair, fur, ashes, or other keepsake material is typically required.

The recommended quantity will be provided in the Collection Kit, product description, or related instructions.

10. Production

Production generally begins after we have:

Received your keepsake material;
Identified it with your order;
Confirmed that sufficient material has been provided; and
Determined that the order is ready for production.

Production times shown on our website are estimates.

Because pieces are individually handmade, production may occasionally require additional time, particularly if a component needs to be remade or additional quality review is required.

A shipping upgrade does not shorten the handmade production period unless we specifically confirm otherwise.

11. Order Accuracy

You are responsible for reviewing all information before submitting your order, including:

Jewelry type
Metal or finish
Ring size
Engraving
Names
Dates
Spelling
Shipping address
Email address
Pet information
Personalization selections

Please contact us as soon as possible if you discover an error.

Changes may not be possible once production has begun.

12. Pricing & Payment

Prices are displayed in the currency shown on our website and may change without notice.

The price applicable to your order is the price displayed at the time your order is submitted, subject to correction of obvious pricing or technical errors.

Applicable shipping charges, taxes, duties, or other fees may be added at checkout.

You authorize us and our payment providers to charge the payment method selected for the total amount of your order.

We may cancel or decline an order where payment cannot be authorized, fraud is suspected, a product is unavailable, or a material or personalization request cannot reasonably be fulfilled.

13. Cancellations, Returns & Remakes

Personalized and made-to-order products are subject to our separate Returns, Cancellations & Remakes Policy.

Because personalized pieces may contain customer-provided and irreplaceable materials, they generally cannot be returned or exchanged in the same manner as ordinary retail products.

Custom orders may become final sale once production begins.

If your order arrives damaged, defective, incorrect, or materially different from what you ordered because of an error by Toujours, please contact us promptly.

14. Jewelry Warranty

Eligible Toujours jewelry is subject to our Jewelry Warranty & Care Promise.

The warranty explains coverage for manufacturing and workmanship issues, as well as exclusions for normal wear, accidental damage, resin aging, plating wear, improper care, and other circumstances.

If you are unsure whether an issue belongs under our Return Policy or Warranty, you do not need to determine that yourself.

Simply contact us and we will help review the issue.

15. Jewelry Care

Jewelry containing resin, pet hair, fur, ashes, plated metals, delicate chains, or other handcrafted elements requires appropriate care.

You agree to follow the Jewelry Care Instructions provided with your product or available on our website.

Damage caused by improper care, chemical exposure, water, excessive heat, prolonged sunlight, impact, unauthorized repair, or misuse may not qualify as a manufacturing defect.

16. Shipping & Delivery

All shipping is governed by our separate Shipping Policy.

Shipping and delivery estimates are not guarantees unless expressly stated otherwise.

Toujours is not responsible for carrier delays or circumstances outside our reasonable control, but we will assist customers with appropriate carrier inquiries when possible.

Special shipping requirements may apply to packages containing cremated remains.

Please review our Shipping Policy before sending any irreplaceable material.

17. Photographs, Stories & Customer Content

You may choose to provide photographs, stories, memories, reviews, testimonials, or other content (“Customer Content”) as part of your Toujours experience.

You retain ownership of your Customer Content.

Providing Customer Content for the creation of your order gives Toujours permission to use that content internally only as reasonably necessary to:

Process your order
Create your personalized product
Prepare personalized packaging
Provide customer support
Maintain necessary business and order records

We will not publicly publish a private pet story, photograph, or personal memory solely because you submitted it as part of an order.

If we would like to feature your pet’s story, photograph, testimonial, or finished keepsake on our website, social media, journal, advertising, or other public materials, we will request appropriate permission separately unless you have already expressly granted that permission.

18. Stories Submitted for Publication

If you voluntarily submit content specifically for publication through a community story, journal, blog, testimonial, or similar feature, you grant Toujours a non-exclusive, worldwide, royalty-free license to reproduce, edit for formatting or clarity, display, and distribute the submitted content for the purpose for which it was submitted.

You continue to own your original content.

We may decline or remove submitted content at our discretion.

Please do not submit photographs, writing, or other content belonging to someone else unless you have permission to do so.

19. Intellectual Property

The Toujours website and its original content, including our branding, logos, packaging concepts, graphics, photographs, product descriptions, text, designs, page layouts, and other materials, are owned by or licensed to Toujours and are protected by applicable intellectual property laws.

Except for ordinary personal, noncommercial use of our website, you may not reproduce, copy, distribute, modify, sell, exploit, or create derivative commercial works from our content without prior written permission.

Nothing in these Terms transfers ownership of Toujours intellectual property to you.

20. Personalized Designs

Purchasing a personalized product does not necessarily transfer ownership of the underlying jewelry setting, manufacturing technique, mold, general design concept, packaging design, production method, or other intellectual property used to create the product.

You own the physical product you purchase, subject to these Terms.

Toujours may continue offering similar jewelry styles, settings, forms, or design concepts to other customers.

We will not intentionally represent another customer’s pet story, photograph, or keepsake material as yours.

21. Prohibited Uses

You may not use our website or Services to:

Violate applicable law
Commit fraud
Submit stolen or unauthorized materials
Infringe intellectual property or privacy rights
Introduce malware or harmful code
Interfere with website security
Attempt unauthorized access to our systems
Harass our staff or other users
Submit knowingly false information
Resell or commercially exploit website content without authorization
Use automated systems to scrape, extract, or reproduce substantial portions of our website without permission

We may restrict or terminate access where we reasonably believe our Services are being misused.

22. Website Availability

We try to keep our website available and accurate, but we do not guarantee uninterrupted access.

The website may occasionally be unavailable because of maintenance, technical issues, security events, third-party service interruptions, or circumstances beyond our control.

We may modify, suspend, or discontinue website features at any time.

Toujours does not control third-party websites or services and is not responsible for their independent content, policies, security practices, or availability.

Our Privacy Policy explains how personal information is collected, used, stored, and disclosed.

Please review that policy carefully, particularly when submitting photographs, stories, shipping information, or other personal information.

25. Disclaimer of Warranties

Except for warranties expressly provided in our Jewelry Warranty & Care Promise and any warranties that cannot legally be excluded, the website and Services are provided on an “as available” basis.

To the maximum extent permitted by applicable law, Toujours disclaims implied warranties not expressly stated in our written policies.

Nothing in these Terms excludes any warranty, guarantee, remedy, or consumer protection that cannot lawfully be excluded.

26. Limitation of Liability

To the maximum extent permitted by applicable law, Toujours will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of our website or Services.

Any limitation of liability relating to customer-provided keepsake material will be applied only to the extent permitted by applicable law and in light of the circumstances involved.

Nothing in these Terms limits liability where limitation is prohibited by law.

27. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Toujours and its officers, employees, contractors, and service providers from claims arising directly from:

Your unlawful use of our Services
Material you submit without authorization
Your infringement of another person’s intellectual property or privacy rights
Your material violation of these Terms

This provision does not apply to claims caused by Toujours’ own conduct where liability cannot legally be shifted.

28. Events Beyond Our Control

Toujours will not be responsible for delays or failures caused by events beyond our reasonable control, including severe weather, natural disasters, carrier interruptions, transportation disruptions, labor disputes, power outages, supply-chain interruptions, governmental actions, emergencies, or similar events.

When such circumstances affect an existing personalized order, we will make reasonable efforts to communicate with you and complete the order when practicable.

29. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, policies, operations, or applicable requirements.

The “Last Updated” date at the top of this page will indicate when the Terms were most recently revised.

Changes apply prospectively unless otherwise required by law.

Your continued use of the website after updated Terms become effective constitutes acceptance of the revised Terms where permitted by law.

30. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, except where another jurisdiction’s mandatory consumer-protection laws apply.

Venue for disputes that may lawfully be subject to this provision will be located in Snohomish, Washington.

Nothing in this section prevents a consumer from exercising rights that cannot legally be waived or restricted.

31. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

32. Entire Agreement

constitute the applicable agreement between you and Toujours regarding your use of the Services and purchases from us.

If product-specific terms conflict with these general Terms, the more specific terms will govern that particular product or service unless prohibited by law.
